These Terms of Use ("Terms") govern your access to and use of the website operated by barKoder Ltd. at https://barkoder.com, including publicly available website content, account functionality and other website-based services that are not governed exclusively by a separate agreement.

The download, licensing, installation and use of the barKoder SDK, related software, Documentation and certain Developer Portal functionality are additionally governed by the applicable barKoder End User License Agreement ("EULA").
Commercial purchases, subscriptions, licenses and professional or other services may also be governed by an Order Form, quotation, statement of work, subscription agreement or other written agreement entered into between barKoder and the applicable customer.
If there is a conflict between these Terms and an applicable EULA, Order Form or other written agreement concerning a particular barKoder product or service, the more specific agreement will control with respect to that product or service.
These Terms do not modify rights or obligations contained in a separately executed agreement between barKoder and a customer unless that agreement expressly provides otherwise.
We may update these Terms from time to time to reflect changes to our website, services, business practices or applicable legal requirements.
The current version of the Terms will be published on this page together with the date on which it was last updated.
Where a change materially affects registered users or an ongoing service, we will provide reasonable additional notice where required by applicable law.

The download, installation, licensing and use of the barKoder SDK and related software are governed by the applicable End User License Agreement and, where applicable, an Order Form or other license agreement.
Nothing in these Terms independently grants you a license to use barKoder software except to the extent expressly stated in these Terms or another applicable license agreement.
Where sample code or other materials are provided under a separate open-source or third-party license, that license will govern the applicable materials.

Where a customer purchases a barKoder product in the course of its trade, profession or business, the commercial terms agreed between barKoder and that customer will apply.

Disputes relating to a barKoder software license, Order Form or other commercial agreement remain subject to the governing-law and dispute-resolution provisions contained in that agreement.
If mandatory applicable law gives you the right to bring proceedings in another jurisdiction or provides protections that cannot legally be waived, nothing in these Terms limits those rights.
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable where permitted by law.

These Terms do not replace, amend or supersede an applicable EULA, Order Form, non-disclosure agreement, statement of work or other separately agreed contract except where expressly stated.
If a specific agreement applies to a barKoder product or service, that agreement will govern the matters within its scope.
